This afternoon, the High Court of Uganda, through Judge Bernard Namanya, moved to nullify the election of Kawempe North MP Luyimbazi Elias Nalukoola. The High Court nullified the election following a successful petition by NRM’s Faridah Nambi Kigongo.

"That the election of Luyimbazi Elias Nalukoola as a Directly Elected Member of Parliament for Kawempe Division North Constituency in Kampala District is set aside," one of the court orders read.

"That the Seat for the Directly Elected Member of Parliament for Kawempe Division North constituency in Kampala District is declared vacant," the statement added.

Justice Bernard Namanya also ordered the Electoral Commission to organize fresh elections in the constituency. "That the Electoral Commission is ordered to organize a fresh election for the Directly Elected Member of Parliament for Kawempe Division North constituency in Kampala District," he added.

The court ruled that the by-election held in March 2025 failed to comply with the Parliamentary Elections Act. The judge noted that the irregularities significantly affected the outcome of the vote, prompting the annulment of Luyimbazi’s election.

The judge concluded that over 16,000 voters were denied the chance to vote, and this affected the election results.

"This Court has reached the decision to set aside the election of Luyimbazi Elias Nalukoola as a Member of Parliament for Kawempe Division North Constituency for two main reasons. 16,640 voters in the constituency, including Farida Nambi Kigongo, were denied the right to vote (disenfranchised), which affected the result of the election in a substantial manner," the judgment read.

Justice Bernard Namanya also revealed he nullified the election on the evidence that Elias Nalukoola personally campaigned on election day. "Luyimbazi Elias Nalukoola personally campaigned on election day at Mbogo Primary School Playground (KAT - MAJ) and Kazo Angola (KAL-KZ) at LC1 office polling stations, which is an offense under section 100 of the Parliamentary Elections Act," he added.

The Kawempe North by-elections took place in March this year. They were organized to replace Muhammad Segirinya, who passed on in January this year.
