The Commercial Division of the High Court of Uganda has temporarily blocked Kenya Commercial Bank (KCB) from selling the home of the late Cedric Ndilima Babu, it has emerged.
In a ruling delivered by Assistant Registrar Mulondo Mastula, the court granted an interim injunction in favour of Babu’s estate after finding that the administrators had raised serious issues that require a full trial.
The application was filed by Cedric’s mother, Olive Zaitun Kigongo, and his widow, Alison Gallagher, who are the administrators of his estate. They sought to restrain the bank from foreclosing on Condominium Unit No. 2 at Plot 1, Fumu Lane, Kololo.
The court has now restrained KCB, its agents and auctioneers from advertising, selling, evicting or in any way dealing with the Kololo property until the main suit is determined.
The prime property is estimated to be worth about UGX 1 billion. At the time of his passing last year, Cedric had reportedly not cleared the outstanding loan.
