Jacqueline Uwera Nsenga will serve her 20-year jail term for the murder of her late husband, Juvenal Nsenga in a disguised vehicle accident, the Court of Appeal has said.
Court presided over by Justices Afonse Owiny-Dollo, Elizabeth Musoke and Cheborion Barishaki upheld the sentence in their verdict delivered on Monday morning.
In September 2014, High court judge Duncan Gaswaga sentenced Uwera to 20 years in prison for murdering her husband.
The case originates from January 2013 when Uwera fatally knocked Nsenga at their home gate in Bugolobi.
Justice Gaswaga then declined to grant the prosecution request for the maximum death sentence, arguing that the couple’s two children would suffer more since they had already lost their father.
He however said Nsenga died of great pain having passed away five hours after the incident and that the convict saind she is remorseful, sorry and ready to repent, in the circumstances. He sentenced her to 20 years imprisonment and the time she has spent on remand would be considered.
He also reminded her that she could appeal if she felt dissatisfied. Uwera through her counsel Isaac Walukagga, appealed the matter. Prosecution originally told Court that Uwera, on 10th January 2013 while at Plot 6 Muzindalo Road, Bugolobi Nakawsa Division in Kampala district with malice aforethought, caused the death of Mr. Nsenga Juvenal.
Nsenga’s legal team argued that the learned trial judge erred in law and fact when he relied on an equivocal out of court statement of the deceased to convict the Appelant.
They further argued that the judge erred in law and fact when he failed to properly evaluate the evidence adduced at the trial and apply it to the law of the offence of murder c/s 188 of the Penal Code Act CAP 120.
During today’s judgement, Uwera was represented by her legal team including David Mpanga, Walukaga Isaac and Sophie Nyombi, while prosecution was represented by Josephine Namatovu the Assistant Director of Prosecutions. Also, Uwera was present in Court.
