A Grade One Magistrate at Nakawa, Frank Namanya, has dismissed the arson and incitement to violence case against Alex Waiswa Mufumbiro, the Deputy Spokesperson of the National Unity Platform (NUP).

In his ruling, the magistrate stated that the prosecution failed to clearly specify where in Kampala the alleged offence took place, making the charge legally insufficient and invalid.

The court, therefore, dismissed the case on grounds of lack of jurisdiction.

However, despite the legal victory, Mufumbiro remains in custody over a separate case involving allegations of participating in an illegal military-style drill.

He was produced before Nakawa Magistrate’s Court earlier today as proceedings continue on the new charges.

Reacting to the ruling, NUP released a statement on its official social media platforms, celebrating the dismissal but expressing concern over what they termed as “ridiculous” charges.

“Today, Nakawa Chief Magistrate’s Court dismissed the case of inciting violence against our Deputy Spokesperson, comrade Alex Waiswa Mufumbiro, for lack of jurisdiction as pointed out by the legal team. Waiswa now remains with the ridiculous charge of ‘unlawful drilling’ at Kawempe Magistrate’s Court together with other comrades. We shall overcome!” the statement read.

The case continues to draw public attention as opposition supporters accuse state agencies of using the courts to intimidate and silence government critics.
