Hearing of the case in which FDC presidential candidate Col Dr Kiiza Besigye is challenging Police for his continued house detention at his Kasangati home, has failed to kick off this morning.
Hearing of the case before Kasangati grade one magistrate Katushabe Prossy was expected to begin this morning, only for the respondent, in this case Attorney General not to appear.
The case was lodged against Kampala North RPC Felix Kaweesi and the Inspector General of Police General Kale Kayihura after police officers under the duo’s command besieged Besigye’s home, right after February 18th elections.
But this morning, Court was surprised to hear that the respondent’s (Attorney General) side could not file its affidavit in reply on time even after they were served early.
Nabbasa Caroline the Deputy DPP who represented the respondent requested court for an adjournment to enable them make consultations with the Attorney General before filing in their Affidavit.
Dr. Besigye who could not make it to court since Police did not allow him, was represented by his lawyer, Counsel David Mpanga.
The magistrate adjourned the matter to tomorrow, and ordered the respondent to file in defense by 4:00PM today
